Terms of Service

These Terms of Service ("Terms") govern your access to and use of LastraPro, including the web application at app.lastrapro.com and the LastraPro mobile application for iOS and Android (collectively, the "Service"), operated by DuplexLabs ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use LastraPro. If you are between 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian, and that parent or guardian must agree to these Terms on your behalf. By allowing your child to use LastraPro, you accept responsibility for their activity on the Service.

2. Account Registration

To use LastraPro, you must create an account with a valid email address and password. You agree to:

• Provide accurate and complete information during registration.
• Keep your login credentials confidential and not share them with others.
• Notify us promptly if you suspect unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. The Service

LastraPro provides tools for Pokemon TCG portfolio management, including:

• Card collection tracking and organization.
• AI-powered card scanning via device camera.
• Peer-to-peer trade sessions with QR code and link-based invitations.
• Vendor buy/sell mode for commercial transactions.
• Portfolio analytics and market price tracking.
• Price alerts and push notifications.

3.1 Pricing Data

Card pricing displayed in LastraPro is sourced from TCGplayer (via tcgcsv.com) and is provided for informational purposes only. Prices may not reflect real-time market conditions, and we make no guarantee of pricing accuracy. You should not rely solely on LastraPro pricing data when making buying, selling, or trading decisions. We support display in multiple currencies (USD, EUR, GBP, CAD, AUD, JPY), but currency conversions are approximate and may not reflect current exchange rates.

3.2 Trade Sessions

LastraPro facilitates peer-to-peer trade sessions by providing a platform to propose and review trades. We are not a party to any trade between users. We do not guarantee the completion, fairness, or outcome of any trade. All trades are conducted at your own risk, and you are solely responsible for evaluating trade offers and the condition and authenticity of cards.

3.3 AI Card Scanning

The AI card scanning feature is provided as a convenience tool. Card identification may not always be accurate, and you should verify scanned results before relying on them. Images captured for scanning are processed server-side and immediately discarded after identification.

4. Subscriptions and Payments

4.1 Subscription Plans

LastraPro may offer free and paid subscription tiers. Paid subscriptions provide access to additional features as described on our pricing page. Subscription details, including pricing, features, and billing frequency, are presented at the time of purchase.

4.2 Billing

All payments are processed through Stripe. By subscribing to a paid plan, you authorize Stripe to charge your payment method on a recurring basis at the applicable subscription interval. You are responsible for maintaining a valid payment method.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features through the end of your current billing period. No refunds are provided for partial billing periods, unless required by applicable law.

4.4 Price Changes

We reserve the right to change subscription pricing. If we change the price of your plan, we will provide at least 30 days' notice before the change takes effect. Your continued subscription after the price change constitutes acceptance of the new pricing.

5. Acceptable Use

When using LastraPro, you agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law.
• Scrape, crawl, or use automated means to access the Service or extract data.
• Attempt to gain unauthorized access to other users' accounts, our servers, or systems.
• Interfere with or disrupt the Service or its infrastructure.
• Use trade sessions to conduct scams, misrepresent card conditions, or defraud other users.
• Create multiple accounts to circumvent bans, limits, or subscription restrictions.
• Resell, redistribute, or commercially exploit the Service or its data without authorization.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Upload malicious content or code through any feature of the Service.

Violation of these rules may result in immediate account suspension or termination without notice.

6. Intellectual Property

6.1 Our Property

The Service, including its design, code, features, logos, and documentation, is owned by DuplexLabs and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.

6.2 Your Content

You retain ownership of the data you enter into LastraPro (collection entries, trade proposals, etc.). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content as necessary to operate the Service.

6.3 Third-Party Trademarks

Pokemon, Pokemon TCG, and related marks are trademarks of The Pokemon Company, Nintendo, and affiliated entities. TCGplayer is a trademark of TCGplayer, Inc. LastraPro is not affiliated with, endorsed by, or sponsored by any of these companies. All third-party trademarks referenced in the Service are the property of their respective owners.

7. Account Termination

7.1 By You

You may delete your account at any time from within the app or by contacting us at support@lastrapro.com. Upon deletion, your account will be deactivated immediately. Your data will be retained for 30 days before permanent deletion, during which time you may request account restoration.

7.2 By Us

We may suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or if required by law. Where possible, we will provide notice before termination and an opportunity to export your data. In cases of severe violations, we may terminate without prior notice.

7.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Any active subscription will be canceled, and no refund will be provided for the remaining billing period. Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Intellectual Property, and Dispute Resolution) will remain in effect.

8. Disclaimer of Warranties

9. Limitation of Liability

To the maximum extent permitted by applicable law, DuplexLabs and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service.

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the greater of (a) the total amount you have paid us in subscription fees during the 12 months preceding the claim, or (b) one hundred dollars ($100 USD).

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless DuplexLabs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@lastrapro.com. We will attempt to resolve the dispute within 30 days.

11.2 Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which DuplexLabs is incorporated, without regard to conflict of law principles.

11.3 Class Action Waiver

To the extent permitted by law, you agree that any disputes will be resolved on an individual basis and that you waive any right to participate in a class action lawsuit or class-wide arbitration against DuplexLabs.

12. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes. We are not liable for any modification, suspension, or discontinuation of the Service.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Effective Date" at the top of this page and notify you through in-app notifications or email. Your continued use of the Service after updated Terms are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and DuplexLabs regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• Force Majeure: We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet disruptions.
